Official Supporters Club Rewards Scheme Terms and Conditions
NON-TICKETING OFFICIAL SUPPORTERS CLUB TERMS AND CONDITIONS
1.1 Chelsea plc is a company registered in England and Wales under company number 02536231, with its registered office at Stamford Bridge, Fulham Road, London, SW6 1HS and with VAT number 726-0650-49 ("Chelsea").
1.2 In these document, when we refer to "we", "us" or "our", we mean Chelsea; and when we refer to "you" or "your" we mean you.
1.4 These Terms are for Chelsea’s non-ticket-based Official Supporters Club (OSC) membership. Chelsea’s ticket-based official supporters club programme remains in place and if you want to find out more information about ticket-based supporters clubs please go to www.chelseafc.com/supportersclubs.
1.5 Before starting or joining an OSC, please ensure you have read these Terms carefully. By starting or joining an OSC, you acknowledge that you have read, understood and agree to be bound by these Terms.
1.6 OSCs are for fans aged 13 or over only. If you are under 13, the right place for you is our site for junior fans, www.juniorblues.com.
1.7 There are no ticket-related benefits in connection with OSCs.
1.8 Chelsea reserves the right to modify or terminate the OSC programme at any time.
1.9 Chelsea will maintain a list of current OSCs on its website.
2 ELIGIBILITY CRITERIA
2.1 Each OSC must have an OSC Secretary. The OSC Secretary is the person starting or renewing the OSC and must:
(a) first become a member of the Chelsea Fan Club to be an OSC Secretary. You can sign up to the Fan Club at www.chelseafc.com;
(b) provide each OSC Member with a copy of or link to these Terms and must explain to the OSC Member in writing that their membership of the OSC will be subject to these Terms;
(c) not use any personal data of any OSC Members for any purpose other than in connection with their OSC, and to use such personal data only in accordance with all applicable data protection laws.
(d) not charge any fees to the members of the OSC (including a fee to become a member of the OSC);
(e) not operate their OSC for any financial gain;
(f) not use their OSC platform to promote any political message or positioning;
(g) hold at least two meetings of the OSC each season, take minutes of those meetings and share those minutes with Chelsea on request.
OSC Vice Secretaries
2.2 Each OSC must have a Vice Secretary, who must accept the position after being nominated by the OSC Secretary. The Vice Secretary may be used as a second point of contact for Chelsea, should Chelsea require to get in touch with a representative from the Supporters Club and are unable to reach the OSC Secretary.
2.3 Each member of an OSC must first become a member of the Chelsea Fan Club in order to become a member of an OSC. You can sign up to the Fan Club at www.chelseafc.com.
3 APPLICATIONS AND RENEWALS
3.1 All OSCs Secretaries must renew their clubs for the upcoming season. If an OSC has not renewed before the deadline then that club is no longer entitled to the benefits set out in Clauses 4 and 5 (such benefits as may be referred to as our “Rewards Scheme” in our communications with OSCs from time to time)].
3.2 Chelsea FC reserves the right to withdraw the status as Official Supporters Club of Chelsea FC of any OSC that does not renew before the deadline, or to promote a new OSC Secretary who agrees to run the OSC in the place of the previous OSC Secretary.
4.1 All OSCs have the following benefits:
(a) they are free to join;
(b) the OSC Secretary will:
(i) receive an official OSC certificate (in electronic form) upon request, which will state that the OSC is an Official Supporters Club of Chelsea FC;
(ii) be given access to an asset library containing the official OSC logo and access to online toolkit where individual social and printed assets (the “OSC Assets”) can be created and used by the OSC Secretary in accordance with Clause 9;
(c) each OSC Member will:
(i) receive an official OSC certificate (in electronic form) upon request, which will state that they are a member of an OSC;
(ii) have access to an online OSC hub and OSC newsfeed on Chelsea’s website and mobile app, with competitions and voting platforms; and
(iii) have access to a monthly OSC-specific newsletter (where the OSC Member has opted in to receive marketing communications).
5 OSC TIERS
5.1 There are four OSC tiers, dependent on the number of OSC Members in the relevant OSC:
5.2 In addition to the benefits described in Clause 4.1(c) above, each tier will receive tier-specific benefits as set out in the Schedule to these Terms.
5.3 Chelsea reserves the right to alter the tier-specific benefits. Merchandise packs containing the physical benefits described in the Schedule will be distributed by post to the address provided by the OSC Secretary. Chelsea is not responsible for any damage or loss caused to the merchandise pack in transit. The contents of the merchandise pack is for the personal, non-commercial use of the OSC Secretary only and may not be used for any commercial purposes (including resale or as a prize in a competition or promotion). To the fullest extent permitted by law Chelsea excludes all warranties in respect of the contents of the merchandise pack.
5.4 Merchandise packs may be distributed by Chelsea at any point during the season.
6 CONDUCT OF OSC MEMBERS
6.1 Chelsea may refuse to admit any individual as an OSC Member or OSC Secretary in its sole discretion.
6.2 Chelsea expects all OSC Members and OSC Secretaries to conduct themselves appropriately. Without limitation, it shall be a breach of these Terms:
(a) if you purchase a ticket for and/or attend any Club match, to breach the Chelsea Ticketing Conditions of Issue (available at www.chelseafc.com/conditionsofissue);
(b) to provide any information to Chelsea at any point that is false, materially incomplete or misleading (or which the Chelsea has reasonable grounds to believe may be false, materially incomplete or misleading);
(c) to fail (at Chelsea’s sole discretion) to act at all times in a civil manner, including (without limitation):
(i) using threatening, foul, obscene, abusive, indecent or discriminatory language or behaviour;
(ii) fighting or engaging in and/or inciting violence; or
(iii) acting in a manner which in Chelsea’s reasonable opinion is prejudicial to or offends Chelsea or its player(s), officer(s), employee(s), member(s), supporter(s) or commercial partner(s) or any individual or corporate entity connected to Chelsea;
(d) to use of the OSC programme or platforms to share for commercial messages or to make financial gain;
(e) to post any content or make any statements in connection with the OSC or Chelsea which are of a political nature or which promote or endorse any political cause;
(f) to suggest, imply or act in any way that could suggest or imply that your views or the views of positions of the OSC are or represent the views or positions of Chelsea;
(g) to supply of any misleading or incorrect information to any Chelsea officer, employer or agent.
6.3 No OSC, OSC Member or OSC Secretary shall endorse, advertise or promote any third party (or such third party’s goods or services) on behalf of or in connection with the OSC, or otherwise suggest or imply any endorsement of or association with any third party (or such third party’s goods or services) by or on behalf of either the OSC or Chelsea.
7 ACTION WE MAY TAKE
7.1 Without prejudice to any other rights or remedies it may have, in the event that Chelsea believes or determines that a breach of these Terms has taken place, Chelsea reserves the right to:
(a) cancel the relevant OSC Member’s or OSC Secretary’s membership of their OSC;
(b) withdraw all or some of the rights and benefits conferred by membership of an OSC;
(c) issue legal proceedings against you for reimbursement of all costs resulting from the breach (including, but not limited to, reasonable administrative and legal costs);
(d) take further legal action against you;
(e) disclose such information to law enforcement authorities as we reasonably feel is necessary to do so;
(f) refuse you entry to, eject or exclude you from our grounds;
(g) suspend or ban you from purchasing Chelsea match tickets, season tickets and/or memberships;
(h) exclude you from any membership scheme maintained or organised by Chelsea or a Chelsea group company (including ticketing memberships, the ticket-based supporters club scheme and the Chelsea Fan Club);
(i) if applicable:
(i) withdraw and/or suspend any and all rights and benefits conferred on you by the Ticketing Conditions of Issue (including rights in respect of match tickets, season tickets and/or memberships;
(ii) withdraw and/or suspend any and all rights and benefits conferred on you by Chelsea Digital Content Terms (including by terminating your access to any digital content), which are available to view here: https://www.chelseafc.com/en/footer/terms-and-conditions
8 DATA PROTECTION
(a) where you provide consent to Chelsea to do so, to send marketing in respect of Chelsea’s, and Chelsea’s commercial partners (a list of which is available at www.chelseafc.com/partners) offers, products or services;
(b) to comply with Chelsea’s legal obligations;
(c) to comply with requests made of Chelsea by any third party, including legal, statutory, or regulatory authorities and/or governing bodies or organisers of football events/tournaments (whether in the UK or otherwise); and/or
(d) for record keeping and other administrative purposes.
8.2 If you are an OSC Secretary, we will include your name and contact details on our website.
8.3 If you are an OSC Member, your full name and email address will be shared with the OSC Secretary. This information is strictly to be used by the OSC Secretary only for contacting the OSC Member with information about the OSC, including events and other activities.
9 TRADE MARKS, LOGOS AND OTHER INTELLECTUAL PROPERTY RIGHTS
9.1 Chelsea protects its intellectual property rights throughout the world and enforces any infringement of these rights diligently.
9.2 Chelsea grants each OSC Secretary the right to use the OSC Assets strictly and solely for the following purposes:
(a) to display on their OSC’s official social media profile in the following manner: (i) Facebook profile picture, cover photo and on Facebook posts; (ii) Instagram profile photo, stories and posts; (iii) Twitter profile picture, posts and cover photo; (iv) Weibo profile picture; and (v) WeChat profile picture; and
(b) subject to receiving Chelsea’s prior written approval on each occasion, on posts for their OSC’s events and on banners for their OSC.
9.3 The OSC Assets, together with any developments or variations to them and any goodwill in or attaching to them shall (as between the Parties) be the property of Chelsea, and neither the OSC Secretary nor any OSC Member shall acquire any rights or interests in the same. The OSC Secretary shall hold any additional goodwill generated in the OSC Assets as bare trustee for Chelsea.
9.4 The OSC Secretary must:
(a) not use any OSC Assets for commercial purposes or for commercial gain, or for political purposes;
(b) not use any of the OSC Assets in any way which suggests the OSC Secretary or the OSC is:
(i) the licensee of a centrally-licensed Premier League rights package (a "Central Licensee");
(ii) entitled to make live transmissions of Premier League matches during the Term; or
(iii) endorsed by or affiliated with a Central Licensee (or any affiliate of a Central Licensee) or with any audio-visual programming or content service carrying the branding of a Central Licensee;
(c) use any of the OSC Assets in any way that is or is likely to be detrimental to the goodwill associated with the OSC Assets or the goodwill or reputation of Chelsea or its or their respective services or products, or that constitutes a deceptive trade practice or unfair competition or that violates any applicable laws or advertising rules and regulations that would or that may disparage the OSC Assets; or
(d) engage in conduct that materially endangers or that may materially endanger Chelsea’s rights to the OSC Assets.
10 OUR LIABILITY
10.1 We do not exclude our liability to you where it would be unlawful for us to do. For example, we do not exclude liability for death or personal injury caused by our negligence or for fraud or fraudulent misrepresentation.
10.2 If we fail to comply with our obligations under these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms or our negligence, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it was an obvious consequence of our breach or if it was contemplated by you and us at the time that you entered into these Terms.
10.3 Nothing in these Terms affects your statutory rights. Advice about your statutory rights is available from your local Citizens' Advice Bureau or Trading Standards Office.
10.4 Save as set out in clause 10.1 above, our maximum liability to you under these Terms is limited to £100.
11 CHANGES TO THESE TERMS
11.1 We may make changes to these Terms from time to time. Please check these Terms regularly to ensure that you understand the up-to-date terms that apply. If we update the terms of these Terms we will post the updated version of these Terms on our website and the updated Terms will apply to you from that point on.
12 OTHER IMPORTANT INFORMATION
12.1 Each of the clauses of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining clauses will remain in full force and effect.
12.2 If we fail to insist that you perform any of your obligations under these Terms, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you.

This link is provided as required by Regulation (EU) No 524/2013 of the European Parliament and of the Council, for information purposes only. We are not obliged to participate in online dispute resolution.
13 GOVERNING LAW AND JURISDICTION
13.1 These Terms are governed by English law.
13.2 You can bring proceedings in respect of these Terms in the English courts. However, as a consumer, if you live in another European Union member state you can bring legal proceedings in respect of these Terms in either the English courts or the courts of that Member State.
13.3 As a consumer, if you are resident in the European Union and you join the OSC of your member state, you will benefit from any mandatory provisions of the law of the country in which you are resident. Nothing in these Terms affects your rights as a consumer to rely on such mandatory provisions of local law.

In the tier-specific benefits table above:
(a) “E-Certificate of Affiliation” is available upon request. To redeem this, please contact the Official Supporters Club team by email: OfficialSupportersClubs@chelseafc.com
(b) “Merchandise Pack” is a gift box that will be distributed by post to the address provided by the OSC Secretary. These boxes will contain signed shirts and other Chelsea FC merchandise. Merchandise packs may be distributed by Chelsea at any point during the season.
(c) “Access to Video Chat Sessions” means that the OSC Secretary (possibly wider) may be invited to join some interactive question and answer sessions with dignitaries from Chelsea FC.
(d) “Apply for OSC Stadium Banner” relates to the selection of OSC Banners in the East and West Stands at Stamford Bridge. The space for these banners is currently filled to maximum capacity, with the opportunity for changes and re-assigning the space occurring at the beginning of each season, subject to availability. (e) “Apply to visit Cobham” allows the OSC Secretary to apply for themselves and a small number of Club Members to make a visit to Chelsea FC’s training ground, based at Cobham. The availability and feasibility of this visit is subject to the Government, Premier League and Chelsea FC restrictions for Covid-19 which will be in place throughout the season.
(f) “Legend Appearance” means the right to request that a Chelsea legend attend an OSC event. Depending on the circumstances, this can either be done in-person or virtually through a video call. The OSC can make such a request once a season. Chelsea gives no guarantees that any Chelsea legend will be able to attend any OSC event.
(g) “Pitch Presentation” means the right to request that the OSC be recognized at a Chelsea home match once in a season. Chelsea has a limited number of pitch presentations each season and gives no guarantee that any OSC will be able to take part in one. Chelsea will notify OSC Secretaries of 1000 Club OSCs of home matches at which a pitch presentation is available. The OSC Secretary must inform Chelsea no later than 14 days before a match if they wish to apply to take part in the pitch presentation.
